Terms of Service

1. Acceptance of Terms
By accessing or using Trumflow ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use the Service. These terms apply to all visitors, users, and others who access the Service.
2. Description of Service
Trumflow provides an AI-powered customer communication platform including live chat, WhatsApp automation, lead scoring, booking management, and analytics tools. The Service is provided on a subscription basis with plans as described on the Pricing page.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at hello@trumflow.com.
4. Subscription and Billing
Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension.
5. Acceptable Use
You agree not to use the Service to: send unsolicited communications (spam); transmit illegal, harmful, or fraudulent content; violate any applicable laws or regulations; attempt to gain unauthorized access to our systems; use the Service to scrape or harvest data without our consent; resell or redistribute the Service without prior written authorization.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you upload to the Service. You grant Trumflow a limited license to process your data solely to provide the Service.
7. WhatsApp and Third-Party Services
The Service integrates with WhatsApp via Twilio, Stripe for billing, and other third-party providers. Your use of these integrations is subject to their respective terms of service. Trumflow is not responsible for the availability or actions of third-party services.
8. Intellectual Property
The Service, including all software, designs, and content created by Trumflow, is the exclusive property of Trumflow Inc. and protected by intellectual property laws. Your feedback and suggestions about the Service become the property of Trumflow without obligation to you.
9. Limitation of Liability
To the maximum extent permitted by law, Trumflow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
Either party may terminate this agreement at any time. Trumflow may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Data export is available for 30 days after termination upon request.
11. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Montreal, Quebec. If you are a consumer in the European Union, mandatory consumer protection laws of your country may also apply.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days notice of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
